Minimal Risk

The probability and magnitude of harm or discomfort in a study are not greater than those ordinarily encountered in daily life or during routine examinations.

Minimal risk is defined in 45 CFR 46.102(j) and 21 CFR 56.102(i). It is a foundational concept that drives many regulatory pathways: studies that are minimal risk may qualify for expedited review or some exempt categories and have different consent and reporting standards.

For research with children, the term 'minimal risk' is interpreted in light of normal childhood experience.
